Terms of service

These terms form the contract between you and MLJ, SASU for the use of CurbsideDrop. They are written to be read once, by a busy operator, without a lawyer in the room.

1. Acceptance

By opening a CurbsideDrop account, sending a drop through the service, or paying a subscription invoice, you accept these terms on behalf of yourself and of the business you represent. If you do not accept them, do not use the service. The person who opens the account confirms that they are authorized to bind the business named on it.

2. What the service does

CurbsideDrop is a daily broadcasting tool for mobile food businesses. It stores a book of parking locations, a menu board and a subscriber list for your business, and it publishes a single message, called a drop, to three destinations: an outgoing SMS to the subscribers who opted in to your list, a public map page hosted on curbsidedrop.com showing your pin, your service hours and your menu, and a queue of written captions that you can copy into Instagram and Facebook. It also produces a report of deliveries, direction taps and menu item interest, and can import an item catalog and daily sales totals from Square or Toast where you connect those accounts. CurbsideDrop is not a point of sale, not a payment processor, not an ordering platform and not a permit service.

3. Eligibility and your account

You must be at least eighteen years old and operate a lawful food business in the United States. You are responsible for the accuracy of the information on your account, for keeping your login credentials private, and for every drop sent from your account, including drops sent by drivers or staff to whom you grant access. Tell us at once if you believe an account has been used without permission. We may suspend an account we reasonably believe has been compromised until we can reach the owner.

4. Acceptable use

You may only text people who gave their consent to hear from your business, and you must honor every STOP request immediately, which the platform does automatically on your behalf. You may not use CurbsideDrop to send political messages, adult content, lending or credit offers, hate speech, or any message unrelated to your food business. You may not upload a purchased, scraped or rented phone list. You may not resell access, share a single truck plan across several unrelated businesses, or attempt to overload, reverse engineer or probe the platform. Breaking these rules can end your account without refund, because carrier rules put the whole network at risk.

5. Plans, prices and billing

Three plans are offered, each billed monthly in United States dollars: Single Truck at $19 per month for one vehicle with 1,500 outgoing texts, Fleet at $49 per month for up to six vehicles with a pooled 6,000 texts, and Commissary at $99 per month for unlimited vehicles under one kitchen account with a pooled 20,000 texts. Messages sent beyond the monthly pool are billed at 1.1 cents each on the following invoice, and we email a warning when your usage passes eighty percent of the pool. Prices are exclusive of any sales or use tax your state or city applies, which is added where required. Your card is charged on the anniversary of your start date. If a payment fails we retry for seven days and email you before anything is suspended.

6. Cancellation and pausing

You may cancel at any time from the account screen. Cancellation takes effect at the end of the period you have already paid for, and no partial month is refunded. There is no term commitment, no cancellation fee and no requirement to call anyone. Seasonal operators can pause instead, which freezes the subscriber list, the corner book and the menu for up to five months at no charge, keeps your map page showing your return date, and restores everything on one tap. We may end an account with thirty days of written notice, refunding any period paid in advance, or immediately in case of a serious breach of section 4.

7. Your data belongs to you

Subscriber numbers, corner books, menus, drop history and reports are your property. We process them only to run the service for you, and we do not sell, rent or share them. You can export everything to CSV at any time. After an account closes, the export stays available for thirty days, then the records are deleted from live systems, with backup copies expiring within a further ninety days. Anonymous, aggregated statistics that cannot identify you or your customers may be used to describe how the platform performs overall.

8. Availability

We target 99.9 percent monthly availability for the drop screen and the map page. Text delivery depends on mobile carriers, whose queues we do not control, and delivery times may vary during large public events. Planned maintenance is announced at least forty eight hours ahead and is scheduled outside United States meal service windows wherever possible. If availability falls below the target in a calendar month, write to us and we will credit that month's subscription.

9. Warranty disclaimer

The service is provided as it stands. Beyond the availability commitment above and the warranties that French law makes non excludable, we make no promise that the service will be uninterrupted, error free, or that a drop will produce any particular level of sales. Figures published on this website describe past results achieved by other operators and are not a forecast for your business.

10. Limitation of liability

To the extent permitted by law, our total liability arising out of or relating to these terms is limited to the subscription fees you paid in the twelve months preceding the event that gave rise to the claim. We are not liable for lost profits, lost sales, spoiled inventory, wasted labor or any indirect or consequential loss. Nothing here excludes liability for death, personal injury, fraud, gross negligence or wilful misconduct.

11. Indemnity

You agree to hold MLJ, SASU harmless from claims, damages and reasonable legal costs arising from messages you sent, from lists you uploaded without valid consent, from content you published on your map page, or from your breach of these terms. We will tell you promptly about any such claim and let you take charge of the defense with counsel of your choosing.

12. Changes to these terms

We may update these terms to reflect changes in the service, in carrier rules or in the law. Material changes are announced by email at least thirty days before they take effect, and the date at the top of this page always shows the version in force. Continuing to use the service after that date means you accept the new version; if you do not, cancel before it takes effect and we will refund any unused prepaid period.

13. Governing law and jurisdiction

These terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the competent courts of Paris, France. Before starting proceedings, both sides agree to attempt a resolution by email or telephone within thirty days of a written notice describing the problem.
